Acceptance of Terms

By accessing and using the crimincujp website (crimincujp.top) and our online fitness coaching services, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using or accessing our services. crimincujp B.V., a company registered in the Netherlands (Registration Number: A63202565, VAT: NL52065474B04), provides these services subject to the following terms and conditions.

Description of Services

crimincujp provides online fitness coaching services including personal training sessions, group fitness classes, nutrition guidance, customised workout plans, and related wellness services. Our services are delivered through virtual platforms and digital communications. We reserve the right to modify, suspend, or discontinue any aspect of our services at any time with reasonable notice to users.

User Obligations and Responsibilities

As a user of crimincujp services, you agree to:

  • Provide accurate, current, and complete information about yourself during registration and throughout your use of our services
  • Maintain the confidentiality of your account credentials and accept responsibility for all activities that occur under your account
  • Follow all instructions and recommendations provided by your assigned fitness coach
  • Consult with a healthcare provider before beginning any fitness programme, especially if you have pre-existing health conditions
  • Use our services only for lawful purposes and in accordance with these terms
  • Respect the intellectual property rights of crimincujp and our coaches
  • Not share, distribute, or reproduce any content provided through our services without express written permission
  • Notify us immediately of any unauthorised use of your account or any other breach of security

Health and Safety Disclaimer

Our fitness coaching services are designed for educational and motivational purposes. You acknowledge that:

  • Exercise involves inherent risks of injury, and you participate at your own risk
  • You should consult with a physician before beginning any exercise programme
  • Our coaches are fitness professionals, but they are not medical doctors and cannot provide medical advice
  • You are responsible for monitoring your own health and well-being during workouts
  • You should immediately stop exercising and seek medical attention if you experience any pain, discomfort, or other symptoms

Payment Terms and Billing

Payment for crimincujp services is due in advance according to your chosen subscription plan. By subscribing to our services, you authorise us to charge your selected payment method for the recurring fees associated with your plan. All prices are listed in Euros (EUR) and include applicable VAT where required. We reserve the right to change our pricing with 30 days' notice to existing subscribers. Failure to pay fees may result in suspension or termination of your access to our services.

Cancellation and Refund Policy

You may cancel your subscription at any time by contacting us at support@crimincujp.top. Cancellations require 30 days' notice and will take effect at the end of your current billing period. We do not provide refunds for partial months of service. However, if you are not satisfied with our services within the first 14 days of your initial subscription, you may request a full refund by contacting our support team.

Intellectual Property

All content provided through crimincujp services, including but not limited to workout plans, nutrition guides, videos, text, graphics, logos, and software, is the exclusive property of crimincujp B.V. or our licensors and is protected by copyright, trademark, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable licence to access and use this content solely for your personal fitness goals. You may not reproduce, distribute, modify, create derivative works, publicly display, or commercially exploit any content without our express written permission.

Privacy and Data Protection

Your privacy is important to us. Our collection, use, and protection of your personal information is governed by our Privacy Policy, which is incorporated into these terms by reference. By using our services, you consent to the collection and use of your information as described in our Privacy Policy. We comply with the General Data Protection Regulation (GDPR) and other applicable privacy laws.

Limitation of Liability

To the maximum extent permitted by law, crimincujp B.V., its directors, employees, coaches, and affiliates shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from or related to your use of our services. This includes, but is not limited to, damages for personal injury, loss of profits, loss of data, or business interruption. Our total liability to you for any claims arising from these terms or your use of our services shall not exceed the amount you paid to us in the 12 months preceding the claim. Some jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages, so the above limitation may not apply to you.

Indemnification

You agree to defend, indemnify, and hold harmless crimincujp B.V. and its officers, directors, employees, coaches, and agents from and against any claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including attorney's fees) arising from your use of our services, your violation of these terms, or your violation of any third-party rights.

Termination

We may terminate or suspend your access to our services immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms of Service. Upon termination, your right to use our services will cease immediately. If you wish to terminate your account, you may simply discontinue using our services and cancel your subscription. All provisions of these terms which by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

Modifications to Terms

crimincujp reserves the right to modify or replace these Terms of Service at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our services after those revisions become effective, you agree to be bound by the revised terms.

Governing Law

These Terms of Service and any separate agreements whereby we provide you services shall be governed by and construed in accordance with the laws of the Netherlands. Any legal action or proceeding arising under these terms will be brought exclusively in the competent courts of The Hague, Netherlands, and you hereby consent to personal jurisdiction and venue therein.

Dispute Resolution

In the event of any dispute arising out of or relating to these terms or our services, the parties agree to first attempt to resolve the dispute through good faith negotiations. If the dispute cannot be resolved through negotiation within 30 days, it may be submitted to mediation. If mediation is unsuccessful, the dispute shall be resolved through binding arbitration in accordance with the rules of the Netherlands Arbitration Institute, or through the competent courts of The Hague, Netherlands.

Severability

If any provision of these Terms of Service is held to be invalid or unenforceable by a court, the remaining provisions will remain in full force and effect. The invalid or unenforceable provision will be replaced by a valid and enforceable provision that most closely matches the intent of the original provision.

Entire Agreement

These Terms of Service, together with our Privacy Policy and any other legal notices published by us on our website, constitute the entire agreement between you and crimincujp B.V. concerning our services. These terms supersede all prior or contemporaneous communications and proposals between you and us.

Force Majeure

crimincujp shall not be liable for any failure or delay in performance under these terms which is due to fire, flood, earthquake, pandemic, governmental action, war, terrorism, or other causes that are beyond our reasonable control. In such circumstances, we will make reasonable efforts to resume normal service as soon as possible.
